These Terms and Conditions ("Terms") govern your use of the websites, mobile games, and services provided by Blue Nova Studios LLC ("Blue Nova," "we," "us," or "our"), including Rewindz, Clay Racer, Linefall, and any future titles (together, the "Services"). By using the Services you agree to these Terms. If you don't agree, please don't use the Services.
01Acceptance of the terms
By downloading, installing, accessing, or using the Services, you ("you" or "User") enter into a binding agreement with Blue Nova Studios LLC. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
02Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
03Your account
Some Services may be tied to your Apple ID via the App Store. You are responsible for the activity that happens through your account and for keeping your device and credentials secure. Notify us at hello@bluenova-studios.com if you believe your account has been compromised.
04License to play
Subject to these Terms, Blue Nova grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Services on devices you own or control, solely for personal, non-commercial entertainment.
You agree not to:
- Copy, modify, reverse-engineer, decompile, or create derivative works of the Services;
- Rent, lease, sell, sublicense, or otherwise transfer the Services;
- Remove any proprietary notices or labels.
05User conduct
While using the Services, you agree not to:
- Cheat, exploit bugs, or use unauthorized tools, bots, or automation;
- Harass, threaten, or harm other players;
- Upload or transmit content that is unlawful, hateful, obscene, or infringing;
- Interfere with or disrupt the Services or servers;
- Attempt to gain unauthorized access to any part of the Services.
06User content
Some Services let you create content — for example, scrambled audio clips in Rewindz. You retain ownership of the content you create. By submitting content to the Services, you grant Blue Nova a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely to operate and improve the Services. You are solely responsible for the content you create and share, and you represent that you have the rights to do so.
07Purchases & refunds
Our games may be offered as paid downloads or include optional in-app purchases through the Apple App Store. All sales are processed by Apple under Apple's terms. Refunds are handled by Apple — please contact Apple Support to request a refund. We cannot directly issue refunds for App Store purchases.
08Intellectual property
The Services, including all artwork, code, audio, text, characters, logos, and the Blue Nova, Rewindz, Clay Racer, and Linefall names and marks, are owned by Blue Nova Studios LLC or our licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any rights in our intellectual property except the limited license in Section 4.
09Third-party services
The Services rely on third parties including Apple (App Store, iMessage, Game Center) and our hosting and analytics providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services.
10Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE NOVA STUDIOS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
12Indemnification
You agree to indemnify and hold harmless Blue Nova Studios LLC and its officers, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
13Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason — including if you violate these Terms. You may stop using the Services at any time by deleting them from your device. Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitation of liability) will continue to apply.
14Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Delaware, and you consent to their personal jurisdiction. Nothing in this section limits your mandatory consumer rights under the law where you live.
15Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll post a notice on this page and update the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
